At Messrs Daniel & Wong (“the Firm“), we respect your privacy and are committed to protecting your personal data (“Data“) in compliance with the Personal Data Protection Act 2010 (“PDPA“).
This Personal Data Protection Notice (“Notice“) explains how we collect, process and use your Data when you use the Firm’s website, appoint or engage us to provide services, or interact with the Firm, including but not limited to meetings, seminars, or events.
This Notice is issued in both English and Malay, in accordance with Section 7(3) of the PDPA. In the event of any discrepancy, the English version shall prevail. We reserve the right to modify, update, or amend this Notice at any time by posting an updated version on our website. Continued use of our website, services or communication with us will constitute acceptance of any updates.
A) COLLECTION OF PERSONAL DATA
“Personal Data” refers to any information that identifies you and which you have provided to us. This may include: –
- your full name, date of birth, nationality, gender, NRIC/passport number, residency status, address, particulars of your spouse or family members, bank account information, and any other information that may identify you or your family members;
- your contact details, including mobile, office, and residential phone numbers, email address, banking details, and financial or creditworthiness information;
- your employment details, including job title, employer’s name, office address, and your relationship with any company (e.g., director, shareholder);
- other relevant information required for the Firm’s legal engagement with you or compliance with legal and regulatory requirements; and
- any additional data provided by you or obtained from third parties.
The Data collected is provided voluntarily by you. However, if you choose not to do so, we may be unable to communicate with you or deliver the services that you require.
B) HOW WE COLLECT PERSONAL DATA
Your Data may be collected through various means, including:
- information provided directly to us during consultations or via our website;
- correspondence through email, telephone, or written communication; or
- public sources (e.g., government departments or agencies, credit reporting agencies, social media, websites, publications, events, seminars).
C) PURPOSE OF PROCESSING PERSONAL DATA
Your Data may be processed and used by the Firm for purposes including but not limited to:
- verifying your identity;
- responding to your enquiries and communicating with you;
- all matters related to the Firm’s legal engagement with you;
- managing the administrative and operational aspects of the Firm, including billing and compliance with legal requirements;
- providing references to (i) editors or researchers of legal ranking publications and/or (ii) clients or potential clients who request referees of past work;
- ensuring the Firm’s compliance with its legal obligations;
- promoting, offering, or marketing the Firm’s services to you;
- any purpose consented to or directed by you; and
- all other purposes related to or incidental to the above.
If you do not consent to the processing of your Data for these purposes, please notify the Firm using the contact details provided in section (F) below.
D) DISCLOSURE AND/OR TRANSFER OF PERSONAL DATA
Where strictly necessary, we may disclose your Data to third parties such as: –
- your authorised representatives or legal advisers (as instructed by you);
- persons required for legal engagements or transactions, including counterparties, advisers, financial institutions, and regulatory bodies;
- regulatory and government authorities, where required by law;
- third parties engaged to process data on our behalf, including providers of storage, data entry, IT services, banks, financial institutions, insurers, professional advisers, and auditors;
- legal directories, journals, and/or potential clients located outside Malaysia for the purposes described in section (C).
Except where permitted by law or this Notice, we will not disclose, sell, or make your Data available to others without your consent.
E) DATA ACCURACY
We strive to ensure that the Data we collect and process is accurate, complete, and up to date. Please notify us promptly of any changes or corrections to your Data. Your Data will be retained only as long as necessary or as required by law.
F) DATA ACCESS AND CORRECTION
Under the PDPA, you have the right to: –
- request access in writing to your Data and obtain a copy of it;
- request for corrections if your Data is inaccurate or incomplete; or
- withdraw your consent or restrict certain uses of your Data.
