Personal Data Protection Notice
At Messrs Daniel & Wong (“the Firm“), we respect your privacy and are committed to protecting your personal data (“Data”) in compliance with the Personal Data Protection Act 2010 (“PDPA”).
This Personal Data Protection Notice (“Notice”) outlines how we collect and process your Data when you access and use the Firm’s website, appoint or engage us to provide services, or interact with the Firm, including but not limited to meetings, seminars or events.
This Notice is issued in both English and Malay in accordance with Section 7(3) of the PDPA. In the event of any discrepancies, the English version shall prevail. The Firm reserves the right to modify, update or amend this Notice at any time by posting an updated version on the Website. By continuing communications with the Firm or use of its services following such revisions, updates or amendments to this Notice, it signifies your acceptance of the revised Notice.
A) Our Collection of Personal Data
“Personal Data” refers to any information that identifies you which you have provided to the Firm and may include the following: –
- name, date of birth, nationality, gender, NRIC/ passport number, residency status, correspondence address, particulars of your spouse or family members and bank account information and any other information that may identify you, your spouse or family members which has been or may be collected, stored, used and processed by the Firm from time to time;
- contact details including mobile, office and residential telephone number, e-mail address, banking details, financial/ creditworthiness information;
- employment details (e.g., private sector, government sector, self-employed, non-working), including job title, employer’s name, office address and details of relationship with a company (e.g., director, shareholder);
- such other information relevant or required for the Firm’s legal engagement with you, or compliance with legal and regulatory requirements; and
- any additional data provided by you or third parties about you.
The Data collected is provided voluntarily by you. However, if you choose not to provide it, the Firm may be unable to communicate with you or deliver the services that you require.
B) How We Collect Personal Data
Your Data may be collected through various means, including but not limited to: –
- information you provide directly to us during consultations or via the Website;
- correspondence through e-mail, telephone, or written communication; or
- public sources (e.g., government department or agencies, credit reporting agencies, social media, websites, publications, events, seminars).
C) Purpose of Processing Personal Data
Your Data may be processed and used by the Firm for purposes including but not limited to the following: –
- verification of your identity;
- respond to your queries and maintain communications with you;
- all purposes related to or in relation with the Firm’s legal engagement with you;
- for the management of administrative and operational aspects of the Firm, including billing and compliance with legal requirements;
- to send as potential referees to (i) editors/researchers in ranking legal publication and/or (ii) client/potential clients who request for referees of past work in relation to any proposal, submissions, tenders or bids;
- ensuring the Firm’s compliance with its legal obligations;
- to promote, offer or market the Firm’s services to you;
- for such other purposes as may be directed or consented to by you; and
- for all other purposes in relation to or incidental to the above.
If you do not consent to the processing of your Data for the abovementioned purposes, please notify the Firm using the contact details in paragraph F below.
D) Disclosure and/or Transfer of Personal Data
Where strictly necessary, we may be required to disclose your Data to third parties such as: –
- your authorized representatives or legal advisers (e.g., when instructed by you to do so);
- any persons required for legal engagements and/or legal transactions, including but not limited to counter parties, other advisors, financial institutions, regulatory bodies;
- regulatory and government authorities where required by law;
- third parties engaged to process personal data on our behalf, including but not limited to providers of archival storage, data entry, computer back-up, disaster recovery services, information technology (IT) service providers, banks, financial institutions, insurance providers, any professional advisors and external auditors;
- your Data may also be transferred out of Malaysia as described above under paragraph (C) for the purposes of legal ranking publications and journals and/or potential clients located outside of Malaysia.
Subject to this Notice and save where permitted by the law, please be assured that we do not disclose, sell, or make your Data available to other persons or companies without your consent.
E) Data Accuracy
We strive to ensure that the Data we collect, use and process is accurate, complete and up-to-date. However, its accuracy largely depends on the information that you provide. To assist us in maintaining accurate records, please promptly notify us of any errors or changes to your Data.
Your Data will only be retained as long as necessary for the purposes outlined in this Notice or as required by law.
F) Data Access and Data Correction
Under the PDPA, you have the right to (i) request access in writing for your Data and obtain a copy of it or (ii) request corrections to your Data if it is inaccurate or incomplete or (iii) withdraw your consent or limit the use of your Data.
